Terms and Conditions

These terms cover using our website and working with us on a project. Please read them before you hire us. If anything is unclear, ask us.

About these terms

These terms apply between you and Nowtek (Pty) Ltd ("Nowtek", "we", "us"). By using this website or accepting a quote from us, you agree to them.

Our Privacy Policy and Refund Policy form part of these terms.

If your quote or project agreement says something different, the quote or agreement wins for that project.

Nothing in these terms takes away any right you have under the Consumer Protection Act, the Electronic Communications and Transactions Act, or any other South African law.

Using this website

This website tells you about Nowtek and our work. It is for information only and is not an offer to do work at a set price.

We try to keep it accurate, but we do not promise it is always complete, current or available.

Do not misuse the site. For example, do not try to break it, copy it in bulk, or use it to send spam or harmful code.

Links to other websites are there to help you. We do not control those sites and are not responsible for them.

Our website content

The Nowtek name, logo, text, images and design on this site belong to Nowtek or the people who licensed them to us. Do not copy or reuse them without our written permission.

Project names shown on the site belong to their owners.

How a project starts

We start by understanding your problem. We then send you a written quote or proposal. It sets out what we will build, the price, the payment steps and a rough timeline.

A quote is valid for 30 days unless it says otherwise.

Your project starts once you accept the quote in writing (email is fine) and pay any deposit it asks for.

Prices and payment

Prices are in South African Rand and are as shown on your quote.

We usually invoice in steps, for example a deposit and then milestones. Invoices are due within 7 days unless the quote says otherwise.

If an invoice is late, we may pause work until it is paid. We will tell you before we do.

Third party costs, like domain names, app store fees, hosting or paid services, are listed on your quote. We will not buy these for you without your go-ahead.

Changes to the work

If you want something added or changed, tell us. We will confirm in writing what it means for the price and the timeline before we do it.

Work outside the quote is only billed once you have agreed to it.

Your part

Good apps need good input. We need you to give us the information, access and feedback we ask for, on time.

If we have to wait for you, the timeline moves by the same amount.

You confirm that anything you give us, like logos, text, photos or data, is yours to use or that you have permission to use it.

If you give us personal information about your customers, staff or learners, you confirm you are allowed to share it with us for the project.

Handover and fixes

When a stage is ready, we show it to you. Please check it and tell us within 10 business days if something does not match what we agreed.

If work does not match what we agreed, we fix it at no cost. This applies to problems you report within 3 months of handover.

If we cannot fix it, we refund a fair part of what you paid for that work. See our Refund Policy.

New features, changes you ask for, and problems caused by other people's changes or third party services are not free fixes. We will quote for them.

Who owns the work

Once you have paid in full, you own the custom work we built for your project.

We keep ownership of our own general tools, templates and code we reuse across projects. You get a permanent right to use them as part of your app.

Open source and third party parts stay under their own licences.

We may mention your project in our portfolio. If you would rather we did not, tell us and we will not.

Hosting and third party services

Our apps often run on services like Vercel, Google Firebase, WhatsApp or payment providers. Those services have their own terms and fees.

We choose reliable providers, but we are not responsible for their outages, price changes or policy changes.

Hosting, support and maintenance after launch are covered by a separate agreement if you want them.

Confidentiality

We keep your business information private. We only use it for your project and only share it with people who need it to do the work.

This does not apply to information that is already public or that the law requires us to share.

Cancelling

You can cancel a project at any time. Our Refund Policy explains what you get back.

We may cancel if you do not pay, or if you break these terms in a serious way and do not fix it within 10 business days of us telling you in writing.

Our liability

We do our work with care and skill. As far as the law allows, we are not liable for indirect losses, like lost profit or lost data, that come from using our website or an app we built.

As far as the law allows, our total liability for a project is limited to the amount you paid us for that project.

These limits do not apply where we acted with gross negligence or on purpose, or where the law does not allow them.

Complaints and disputes

If you are unhappy, tell us first at dallas@nowtek.co.za. We will reply within 5 business days and try to sort it out.

If we cannot agree, either of us may suggest mediation before going to court.

If the Consumer Protection Act applies to you, you may also approach the Consumer Goods and Services Ombud or the National Consumer Commission.

South African law applies to these terms. South African courts have jurisdiction.

Electronic messages and records

Emails and electronic messages between us count as "in writing".

You can save or print these terms at any time. Ask us and we will email you a copy.

We keep records of quotes, agreements and invoices for at least 5 years.

Changes to these terms

We may update these terms. The date at the top shows the latest version. Changes do not affect a project already agreed, unless you agree to them.
